    A litigant may repeatedly sue the same party for substantially the same reasons, often after a previous case has been dismissed. 

  • No reasonable grounds:

    The claims are brought without merit and a reasonable basis, amounting to an abuse of the court’s process. 

  • Harassing purpose:
    The primary goal is to harass, annoy, or cause detriment to the other party.
Why vexatious litigation is a problem
  • Waste of resources:

    It wastes the time and money of the courts, the opposing parties, and their legal representatives. 

  • Unfair burden:

    It places a significant and unfair burden on the defendant who is forced to repeatedly defend against baseless claims. For example to make me destitute and very distraught.

  • Abuse of justice:

    It undermines the principle of access to justice for those with legitimate claims, as court resources are being used on non-meritorious cases.
